To tell the truth, I got A LOT of such a messages if I don't use 
vrc_minrate and vrc_maxrate. If I use vrc_maxrate I got just one.

And I mentioned the muxer because I confused such messages with 
"Error in stream: PTS earlier than SCR!"
that mencoder produces too.
